I think you are missing the “d” in “drive” in that link. :slightly_smiling_face:

Here’s a key portion of the decision:

WITH RESPECT TO MR. GITTER AND MS. HIRSCH’S
CAUSE OF ACTION FOR AN ACCOUNTING, THEIR COUNSEL
CLARIFIED DURING TRIAL THAT THEY SEEK ONLY A FINDING
THAT AN ACCOUNTING IS OWED BY MR. JONES AND HIS RELATED
CORPORATIONS TO MR. GITTER AND MS. HIRSCH FOR THE
OPERATIONS OF THE PARTNERSHIP AFTER OCTOBER 10, 2023.
IT WAS UNCONTESTED THAT MR. JONES TOOK OVER
THE BUSINESS AND EXCLUDED MR. GITTER AND MS. HIRSCH
AGAINST THEIR WILL EVEN THOUGH HE WAS A MINORITY
PARTNER.

HIS ACTIONS IN THIS REGARD BREACHED THE DUTIES
OF LOYALTY AND CARE OWED BY A PARTNER TO THE
PARTNERSHIP AND THE OTHER PARTNERS. SEE CALIFORNIA
CORPORATIONS CODE SECTION 16404.

HAVING BREACHED THESE DUTIES, MR. JONES AND
HIS RELATED BUSINESSES MUST ACCOUNT FOR THE USE OF
PARTNERSHIP PROPERTY DURING THE PERIOD AFTER
OCTOBER 2023.

THERE WAS SOME EVIDENCE PRESENTED REGARDING
MR. JONES’ MISUSE OF THE PARTNERSHIP PROPERTY DURING
THIS PERIOD, BUT THE COURT LEAVES A FINAL DETERMINATION
FOR THE ACCOUNTING ITSELF FOR THE LATER TRIAL OF OTHER
CAUSES OF ACTION OR FOR THE CONTEMPLATED CONTEMPT
PROCEEDINGS REGARDING USES OF FUNDS AND ASSETS THAT MAY
HAVE VIOLATED THE COURT’S PRELIMINARY INJUNCTION.

A second phase of the trial is still to come and in the meantime Gitter and Hirsch are in control since they have 2/3 ownership.

There’s certainly a news story here for somebody who wants to dig into it.

I visited Epicurus and had a long chat with Hillary and Eric. Wow, what a saga those two have been put through, and it’s not even over yet. For anyone who is interested, I recommend reading the court’s decision and/or dropping in for a chat with Hillary or Eric (they have had to deal with even more bullshit than what is revealed in the decision).

They shared that they still have a lot of work to do to get the business back on track, but they are putting in the time, money, and effort necessary to get there. They mentioned that prior management had jacked up some prices so much that, even with recently imposed tariffs, they are actually lowering prices now on many items to get back to the lower margins they had before the adjudged unlawful takeover (my words) by prior management.

Even though the current selection at the store is not quite where it was at its peak, there are still lots of great finds. The tinned fish section is so good, as always, and has a lot of new options that were not there on my last trip earlier this year. I picked up over 30 tins, almost all of which were new to me. The olive oil selection is back to its glory days. Butter selection still good. The baking and cheese sections are still recovering – Hillary knows this and is working on it.

I encourage you all to stop in and support Epicurus as it recovers.

Thank heavens!

After my Christmas debacle, I never intended on going back. But I am very happy the shyster has been removed, and there are real adults back in charge.

Can’t wait to drop in sometime soon.

I’m presuming this is approved by the new-old management.

Why would you think they approved it? Is that guy one of those pay-to-play influencers?

I was in there yesterday. I don’t think they need “pay to play” influencers. The place is looking great. Hillary said they are still struggling with tariff problems, but a big order was coming in tomorrow, i.e. today.

It’s looking great. Spotless, and the shelves are filling up. Business looks great; the people in front of me had a huge order.

Hillary says the holiday orders will be coming in soon, so I hope your experience this year is so much better than last year.

So happy they are back!

Saturday’s excursion took me to Epicurus and it is back!

The store was incredibly busy…lots of shoppers and both Hilary & Eric were busy sorting through a large delivery.

The selection of products is back to being great. Lots of new cheese options. Plenty of Christmas items available, and the snacks and chip options were great.

Highlights consumed today:

  • Harbison soft-ripened cheese from Jasper Hill
  • Caramelized onion white cheddar
  • Sheep’s milk with truffle from Italy
  • Sauccison a’lail

Harbinson is one of my top 5 cheeses. So unique and delicious. Stunning on a cheese plate!

Glad they are back!

Rush Creek Reserve is very similar to Harbison. Both are patterned after Vacherin Mont d’Or.

Thanks! I had seen and bought the Harbinson there before. But I had completely missed the Rush Creek! Awesome!

My first 2026 visit to Epicurus today. Place looks great! It is so clean, and everything works - even the merchandizer where the light had been out for two years. They had just received a shipment of conservas. Tommy was helping a young woman navigate the multiple choices. Hillary led me through the new chocolate inventory. Apparently Eric insisted on expanding the chocolate selection. There are selections from at least five, if not seven countries. I bought milk chocolate and salted caramel covered licorice for my wife, as well as a milk chocolate hazelnut bar. I don’t like licorice, but I tasted it and it was great! Eric was hilarious as always.

Epicurus is definitely firing on all cylinders. So great to have it back. Hillary says they are expecting more inventory soon. I know it’s a schlep for most of you, but it is so worth it.

Blasphemy! I kid, but glad to hear they are back at their best. Looking forward to stopping by next time I’m over that way.

My wife prefers it. I’m not much of a chocolate person, although I do like to cook with it.
