I also kind of assume that the landlord issue might’ve been the landlord stating that they needed a cut of the profits, or Sergio needed to find a new place to live/work…

Or the landlord raised the rent. Or lives next door and got tired of the crowds.

I wonder if the landlord has any liabilities when renting the space out as a residence, but the tenant uses it as a restaurant space. Not a landlord, so I have no idea, but curious.

I’d imagine the umbrella policy for that property would be quite expensive…

Yes. A landlord can be liable or get dragged into a lawsuit if a lessee or a lessee’s customer sustains bodily injury or property damage while on the owner’s property and sues over it.

That’s why a lessor should always carry lessor’s risk insurance and require the lessee to carry adequate general liability insurance of their own while adding them as an additional insured to shield themselves of such potential outcome. The typically happens on a leasing contract.

Typically, the premium is rated based on square footage. For a 5,000 Sq Ft property and exposure of this type, it should be no more than $500 to 750 in premium.

Good reading. I just finished a 8 month eviction process. The renter was trying to sue me from everything to the septic system , uninhabitable building , permit to rent , housing authority , well of course there was covid
She moved into a brand new remodeled studio .
I made it beautiful. Walking in last week, i was sickened from what I saw.
Landlords have zero rights in California. I could write a book on the eviction process.
I finally got my property back through lawyers and the court system.
Will I be a landlord again. I don’t think so . Building destroyed.
I’m so happy it’s over

There is or at least was a law in California that you couldn’t evict someone if the unit didn’t have a working toilet. So some tenants would destroy the toilet to postpone eviction.

Yes . That’s why she flushed rags down the toilet. The septic guy pulled them out of the mainline when he pumped the tank . Then I had the leech field tested . It was in good working condition. Once I had the report I knew I had a ace in the hole. After the lockout I have to hold her belongings for fifteen days . She will have to notify the attorney if she wants to come get it . It’s basically all garbage. I will be making dump runs next Saturday.

An ownership society would be great if it meant everyone who would rather own their homes than rent could afford to.

I was a renter for fifty plus years . Kept the property clean . Paid the rent on time . Notified the owner if there was a major problem. Nothing wrong with being a renter . I lived in the last house for 24 years . My rent was never raised .on good terms.

Access to capital has always been an issue with minority and immigrant restaurants but amazed no one has approached him to partner up
